These terms apply to your use of the offsight. website (the Website). The Website is operated by ORGsight Pty Ltd ABN 53 633 639 157 trading as offsight. (we, us, our). By using the Website you agree to these terms. If you don't agree, please don't use the Website.
Bookings of our space are covered separately by our Booking Terms & Conditions, and how we handle personal information is set out in our Privacy Policy.
1. Information on the Website
We aim to keep the information on the Website accurate and up to date, including descriptions, photos, floor plans, capacities, inclusions and prices. However, it is provided as general information only. Floor plans are indicative and not to scale, and photos may not reflect the exact setup on the day of your booking.
Prices shown are indicative "from" rates in Australian dollars and include GST. They may change without notice. The price that applies to your booking is the price in the written quote or confirmation we send you.
2. Enquiries
Submitting an enquiry through the Website does not create a booking or reserve a date. A booking is only confirmed once we have accepted it in writing and received your deposit, as set out in our Booking Terms & Conditions.
When you send an enquiry, you must provide information that is accurate and that you are entitled to share.
3. Acceptable use
You must not:
- use the Website for any unlawful, fraudulent or misleading purpose;
- submit spam, automated or bulk enquiries, or content that is offensive or infringes anyone's rights;
- attempt to gain unauthorised access to the Website, its servers or any connected system, or interfere with its operation; or
- copy, scrape or reproduce the Website's content except as allowed by these terms.
4. Intellectual property
The Website and its content, including the offsight. name and logo, text, photos, floor plans and design, are owned by or licensed to us. You may view and print pages for your own personal or business use in considering a booking. You must not otherwise copy, modify, publish or use any of this content without our written permission.
5. Third-party links and services
The Website links to third-party services such as Google Maps, and mentions third-party suppliers such as our catering partner. We don't control those services and aren't responsible for their content, availability or practices. Your use of them is subject to their own terms.
6. Availability
We don't guarantee that the Website will always be available, uninterrupted or free of errors, viruses or other harmful components. We may change, suspend or remove any part of the Website at any time.
7. Liability
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
Subject to that, to the maximum extent permitted by law, we are not liable for any loss or damage (including indirect or consequential loss) arising from your use of, or inability to use, the Website or any reliance on its content.
8. Changes to these terms
We may update these terms from time to time by publishing a new version on the Website. The updated terms apply from the date they are published.
9. Governing law
These terms are governed by the laws of Western Australia. You and we submit to the non-exclusive jurisdiction of the courts of Western Australia.
